1. Introduction
These Terms and Conditions ("Conditions") govern your access to and use of our website (the "Website"), platform features, and all experiences, activities, events, services, and products offered by The Modernists or its partners ("Experiences").
By continuing with your application or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Conditions.
2. Acceptance of Conditions
By accessing or using the Website or any Experiences, you agree to be bound by these Conditions. By continuing with your application, you consent to our Terms & Conditions.
If you have opted into our marketing communications, you consent to being contacted through our communication channels.
We reserve the right to modify these Conditions at any time. Your continued use of the Website or participation in Experiences following any modification constitutes your acceptance of the revised Conditions.
3. The Modernists Platform
The Modernists platform facilitates the discovery and booking of Experiences offered by various member clubs, co-working spaces, and other locations ("Venues").
We do not own, manage, or operate these Venues, nor are we responsible for any aspect of their services, facilities, or conduct. When accessing a Venue, you agree that your participation and behaviour are entirely at your own risk and liability.
By joining our platform, you consent to having a profile on our web application, which may include your name, profile picture, and preferences visible to other community members.
4. Member Conduct & Liability
4.1 Members are solely responsible for their behaviour and conduct while attending any Venue, Experience, or Event.
4.2 Members must comply with all Venue rules, policies, and terms and conditions, including dress code, health and safety, and payment obligations.
4.3 Members are directly liable for any damages, losses, misconduct, or unpaid bills incurred at a Venue or during any Experience.
4.4 The Modernists accepts no liability for any member’s actions, omissions, or disputes with Venues, service providers, or other attendees.
4.5 Any outstanding balances, fees, or claims raised by a Venue or partner must be settled directly with them.
4.6 Members shall not act in a way that may harm, discredit, or bring The Modernists or its community into disrepute.
5. Membership Options & Passes
Individual Memberships
We offer three tiers of individual memberships:
1. The Socialite
Pay-as-you-go basis with a one-off joining fee of £50 (non-refundable).
Access to up to three club experiences per month.
Access to select monthly member-only event passes and experiences through a flexible Pay-As-You-Go system.
Entry to The Modernists’ dedicated WhatsApp community.
Basic Pay-As-You-Go members’ platform access.
2. The Connoisseur
Monthly membership fee of £120.
No joining fee.
Access to up to three club experiences and one event per month.
Additional experiences available on a pay-as-you-go basis.
Full access to The Modernists community and website features.
Members-only brand offerings and priority invitations to exclusive partner events.
3. The Aristocrat
Annual membership fee of £1200 (including two complimentary months).
No joining fee.
Access to up to six club experiences and two member-exclusive events per month.
Additional experiences available on a pay-as-you-go basis.
Complete access to all Modernists community features and benefits.
Business Memberships
We offer three tiers of business memberships:
1. St. James’s Tier
£50 per month (billed monthly).
One month trial included.
Basic profile on our web application.
2. Mayfair Tier
£150 per month (billed monthly).
Monthly feature in the member newsletter.
Access to private communities via the app.
Access to 3 clubs & 1 event per month for one individual in the company.
Promotion of business events to the community.
Permanent placement in the website’s brand perks section.
3. Regency Tier
£200 per month (billed monthly).
All benefits of the Mayfair Tier.
Full access to a The Modernists individual membership (equivalent to The Aristocrat).
Access to 6 clubs & 2 events per month for one individual in the company.
Additional services including Club Bookings, Event Bookings, Personal Introductions, and Room Hires.
6. Subscription Terms
Subscriptions have a monthly or annual billing cycle (“Subscription Period”) as specified in the membership details.
You may terminate your subscription at any time, but it will continue until the end of the current Subscription Period.
No refunds will be issued for unused portions of a Subscription Period unless required by law.
Subscriptions renew automatically each month or year, and you authorise us to debit your nominated payment method accordingly.
Passes and Experiences expire at the end of the Subscription Period and cannot be carried over or refunded.
Passes may be restricted to certain Venues or Experience types.
7. Cooling-Off Period and Cancellation Rights
As per consumer protection laws, you have the right to cancel your membership or purchase within 14 days from the day you enter into the contract or make the purchase ("Cooling-Off Period"). This applies to both membership subscriptions and one-off purchases of Passes or Experiences made through our Website.
Conditions of Cancellation:
To exercise your right of cancellation, you must notify us of your decision by contacting info@themodernists.co within the Cooling-Off Period. If you cancel during the Cooling-Off Period, we will refund any payments received from you, excluding any proportionate costs for services or Experiences already provided within that period. The refund will be made using the same payment method used for the initial transaction, unless otherwise agreed. No refunds will be issued if you have fully utilized the membership, Passes, or other purchased services during the Cooling-Off Period.
Exceptions:
You will not have the right to cancel once you have accessed or participated in any digital or in-person Experiences or Events provided during the Cooling-Off Period. This cancellation right does not apply to business-to-business transactions or purchases that fall outside the consumer rights framework.
8. Venue Access
We cannot guarantee the availability of specific Venues, Experiences, content, or features.
You must comply with the Terms and Conditions of any Venue that you are granted access to.
You are solely responsible for settling any damages, charges, or unpaid bills incurred.
The Modernists is not liable for any Venue’s service quality, staff behaviour, or safety standards.
Venues may refuse entry or service at their discretion.
Any dispute or issue arising from a Venue visit must be addressed directly with the Venue.
9. Digital Experiences
We may offer access to live or on-demand audio or video Experiences. You are responsible for ensuring your technology and internet connection meet the required standards. The Modernists accepts no liability for connection or access issues.
10. Your Profile & Account
Your profile with The Modernists is for your personal use only.
You shall not create multiple profiles or transfer passes to third parties.
You shall not utilise the Website, Passes, or Experiences for commercial purposes under individual memberships.
You must provide accurate, current, and complete information.
Sharing confidential information (e.g., passwords) may result in immediate termination.
You must be at least 18 years old to use the Website or participate in Experiences.
11. Communications
By providing your information, you consent to The Modernists contacting you for marketing purposes. You may opt out of marketing communications at any time.
12. Fees, Billing, & Cancellation
Recurring Charges:
When commencing a subscription, you authorise us to debit you the initial fee and a recurring fee at the prevailing rate, which may change. Subscription Period: Your initial Subscription Period shall be billed immediately. Subscriptions automatically renew, with billing occurring on the same date of each subsequent Subscription Period. We may adjust billing timing as necessary.
Refunds:
Our fees (including Subscription, Experience, processing and other fees) are non-refundable unless expressly stated otherwise at the time of purchase. We reserve the right to charge for utilised services or products prior to cancellation and may request proof of any change in circumstances. This does not affect your statutory rights.
Price Adjustments:
We reserve the right to modify prices at any time. We will notify you through the Website, email, or other suitable means.
Payment Methods:
You can update your payment method information on our Website.
Subscription Cancellation:
You may cancel your subscription with at minimum 1 working day’s notice before the renewal date via our website or by contacting info@themodernists.co. For example, if your subscription is due to renew on a Sunday, you would be required to contact us or cancel your subscription directly by 7:59am on the previous Thursday. You will retain access through the conclusion of your current pre-paid Subscription Period.
Additional Fees:
We reserve the right to modify our fees policy, introduce additional fees, and alter the amount of any fees at any time.
13. Promotions
We may offer trials, gift vouchers, referral programmes, and other promotions. Specific terms apply as communicated at the time of the offer.
14. Removal or Termination of Membership
The Modernists reserves the absolute right to:
Suspend or terminate any membership, account, or participation in the community at any time, with or without notice, and for any reason, including but not limited to breach of these Conditions or Venue rules, inappropriate behaviour, or conduct deemed detrimental to the community.
Deny future membership or access to the platform.
Termination does not relieve the member of any outstanding financial obligations or liabilities incurred prior to termination.
15. Intellectual Property
All intellectual property rights in the Website and Experiences are owned by The Modernists or its licensors. You are granted a limited, non-exclusive licence to access and use the Website and Experiences in accordance with these Conditions. You may not copy, modify, distribute, sell, or exploit any content without our prior written consent.
16. Disclaimers & Limitation of Liability
To the fullest extent permitted by law:
The Website and Experiences are provided “as is” and “as available.”
The Modernists disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
The Modernists is not liable for any act, omission, or negligence of any Venue, partner, or third party.
We are not responsible for any injury, loss, damage, or expense arising from your participation in any Experience or Venue.
In no event shall The Modernists be liable for indirect, incidental, consequential, or punitive damages.
Your sole remedy for dissatisfaction is to discontinue use of the Website and Experiences.
17. Indemnity
You agree to indemnify and hold harmless The Modernists, its officers, directors, employees, contractors, agents, and licensors from and against all claims, losses, liabilities, costs, or expenses (including legal fees) arising from:
Your use of the Website or Experiences;
Your attendance at any Venue or Event;
Your conduct or breach of these Conditions or Venue terms; or
Any claim brought against The Modernists due to your actions or omissions.
18. Governing Law & Dispute Resolution
These Conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.
19. Entire Agreement, Severability, & Waiver
These Conditions constitute the entire agreement between you and The Modernists.
If any provision is found invalid or unenforceable, the remainder shall remain in effect.
No waiver of any breach shall be deemed a waiver of any other or subsequent breach.
